Powers of the General Assembly of Administrative Courts According to Palestinian Legislation

Abstract

The General Assembly is a fundamental pillar of administrative courts due to the powers and roles assigned to it in developing judicial and administrative work for judges, as well as in shaping administrative and financial policies, based on the supervisory nature granted to it by the legislator.

This research will examine the powers entrusted to the General Assembly of Administrative Courts in Palestine under Decree-Law No. (41) of 2020 and the General Assembly’s Internal Regulations No. (2) of 2023. The study will focus on the scope of these powers, which are exercised in two main areas: legislative and administrative. It highlights the legislative framework within which the Assembly operates, particularly its role in the preliminary stages of issuing regulations by the President, who is authorised by law to promulgate them. Additionally, the research will address the administrative powers concerning judges, such as recommendations for appointment, secondment, transfer, and acceptance of resignations.

Furthermore, the study explores the legal restrictions imposed by the legislator on the exercise of the Assembly’s powers, including adherence to constitutional principles such as the separation of powers and the principle of equality. It also emphasises the requirement of legality, ensuring compliance with governing legislation and preventing conflicts of interest, particularly in financial and judicial matters.

The research concludes with a set of findings and recommendations based on the descriptive-analytical and deductive methodologies employed by the researcher.
