Mixed Economy as One of the Methods of Managing Public Facilities in Palestinian Legislation

The public facility is of great importance in providing services to the public and meeting their needs, as it is the best means to meet the needs of individuals. It is considered the basis of administrative law, from which its most important principles are derived. Also, it is considered one of the most important criteria for the application of administrative law and its competences. Therefore, the theory of public facility has gained special importance, as it contains within it the public employee, public funds, and admin strative contracts concluded by the administration.
This research aims to identify the mixed economy approach as one of the methods of managing public facilities in Palestine. Additionally, it gains special importance in identifying the legal system governing the public facility, which relates to how it is established, abolished, managed, regulated, and its operational procedures.
This research has been divided into two sections, the first discusses the nature of the mixed economy, which has been divided into two subtopics: Defining the mixed economy and exploring the similarities and differences between the mixed exploitation system and the franchising method. As for the second section, it addresses the legal regulation of mixed economy companies, which is divided into two subtopics. The first deals with the legal system for mixed economy companies, while the second addresses the outcomes resulting from adopting the mixed economy system.
The problem statement of the study revolved around the extent of implementation of this system in managing public facilities in Palestine, and its impact on the regular and steady functioning of the public facility.
The study yielded several a number of results, the most important of which is that the mixed exploitation system is one of the methods of managing public facilities, based on a partnership between public administration and the private sector.
It also concluded with several recommendations, the most important of which is the necessity of establishing special legislation to regulate the work of mixed economy companies in Palestine.
