Dissolution of the Palestinian Legal Council in light of the Decision of the Palestinian Constitutional Court

Abstract

The study of the issue of dissolving the Palestinian Legislative Council in light of the decision of the Palestinian Constitutional Court aims to clarify the form of the Constitutional Court's decision to dissolve the Legislative Council because it constituted a wide Palestinian legal and political controversy between those who consider it an unconstitutional decision that will perpetuate the separation between the two parts of the homeland and those who consider it a constitutional and legal violation of the decision that makes it null and unconstitutional , unpatriotic and a crime,due to the issue’s importance in enriching the debate on ways to address the Palestinian division and promote democracy in Palestine. Further, The  topic poses a major problem about the legitimacy of the Constitutional Court's decision to dissolve the Palestinian Legislative Council.

To answer the problem, the bilateral division was relied on in two sections, the first entitled  the nature of the Palestinian Legislative Council and its powers, and the second section entitled Legal and political considerations for the legislative solution on the Palestinian arena and the danger of disrupting it, and the study concludes with a conclusion, containing many results and recommendations
