يشهد العصر الرقمي تطورًا غير مسبوق في أدوات الإثبات الجنائي، مع تزايد الاعتماد على تقنيات الذكاء الاصطناعي (AI) في جمع الأدلة وتحليلها، مما يطرح إشكاليات جوهرية تتعلق بمشروعية هذه الأدلة، ومدى موثوقيتها، وحجيتها أمام القضاء. حيث تهدف الدراسة إلى تحليل الإطار القانوني والمعيار الناظم لاستخدام أدلة الذكاء الاصطناعي في المسائل الجنائية، من خلال مقارنة تحليلية بين الأنظمة القانونية في الدول العربية، ودول الاتحاد الأوروبي، واليابان.
إن الدراسة الماثلة تتناول نماذج متعددة لاستخدام الذكاء الاصطناعي في العمل الجنائي، مثل تقنيات التعرف على الوجوه، وتحليل البيانات الضخمة، وأنظمة التنبؤ بالسلوك الإجرامي، وتبحث مدى اتساق هذه التطبيقات مع المبادئ الدستورية، لا سيما مبدأ الشرعية الجنائية، وضمانات المحاكمة العادلة، وأخيرا وليس آخرًا حماية الخصوصية.
ومن الجدير بالذكر أنها كشفت عن تباين واضح في المواقف التشريعية والقضائية؛ ففي حين تتجه دول الاتحاد الأوروبي نحو تقييد استخدام هذه الأدلة ووضع أطر تشريعية صارمة لحماية الحقوق الأساسية، تعتمد منهجًا تكامليًا ومرنًا، يقوم على إدماج الأدلة الرقمية وتقنيات الذكاء الاصطناعي ضمن التشريعات العامة دون إصدار قانون موحد، مع إرساء ضوابط قضائية صارمة تكفل حماية الخصوصية وضمان مشروعية الدليل، مع غياب إطار قانوني موحّد أو معايير فنية ضابطة.
وخلصت الدراسة إلى أن القبول القضائي لأدلة الذكاء الاصطناعي يظل رهينًا بمدى موثوقية التقنية المستخدمة، وشفافية خوارزمياتها، ومدى احترامها لمبادئ العدالة الإجرائية. كما دعت الدراسة إلى ضرورة تطوير تشريعات وطنية واضحة، وإرساء معايير فنية وقانونية مشتركة، تضمن توازنًا فاعلا بين مقتضيات مكافحة الجريمة وحقوق الأفراد.
